You see him slowing down when the BMW was on the left. He goes for the pass when the BMW has moved to the right. The ambiguous point here is that the BMW had not put on the right indicator. Nevertheless the BMW driver had to be aware of his surroundings especially the rear. It looks like the BMW never saw the Porsche approaching or passing. If he clipped the rear that means he would have seen at the last milli-second still time enough to take the outer line.

However, fast and experienced drivers during TF do need to consider that there are newbies, roookies on the track and adapt. Rather than pulling up on the tail and trying to force past in a corner, wait for the slower car to move right. In certain cases, it may not be possible to move right at speed due to physics, please wait for the guy ahead to move right. TF is not a race by any means.
